Please read the terms and conditions of this License Agreement (hereinafter, the "Agreement") carefully before using the Ohio Lottery Mobile Application (hereinafter, the "App"). Any software, data, integrations, features, content or information made available as part of the App shall hereby collectively be referred to herein as the App. The App is offered for your use only and is subject to the Agreement in its entirety. Your use of the App confirms your understanding and acceptance of the terms of this Agreement and any changes to the Agreement published hereafter.

Third Party Services. The Ohio Lottery does not charge any fees in association with the downloading, installation, or use of this App. Likewise, the Ohio Lottery is not liable for any hardware, software, connectivity or any other fees that you incur as a result of using the App. Your use of the App is subject to your agreement with your mobile phone service provider, internet connectivity provider or other service provider related to your device. Any charges related to content, data or downloads are subject to your price plan and usage as outlined in your agreement with any applicable service provider.

Limited License. Subject to the Agreement, the Ohio Lottery grants you a license for your individual, private, non-commercial use of the App for the device with the original download and installation of the App.

Prize Claims and Wagers. The information made available through the App does not constitute a legitimate wager or claim for prize payment. Only an official wager purchased at an Ohio Lottery Retailer constitutes a valid claim. All valid claims are subject to inspection and verification by the Ohio Lottery.

Age Restrictions. While the App does not have any content that is age-restricted, the Ohio Lottery does not authorize the purchase of Ohio Lottery products for any person under the age of 18.

Liability. The use of this App is provided on an "as is" and "as available" basis, and without any warranty of any kind or nature. The Ohio Lottery does not warrant that use of this App will be uninterrupted, fault-tolerant or error free. There are no express or implied warranties, including warranties of merchantability, fitness for a particular purpose, title, accuracy, correspondence with description, satisfactory quality or non-infringement.

You further agree that in no event will the Ohio Lottery be liable for any damages including, without limitation, direct, indirect, incidental, special, consequential, or exemplary damages or expenses, arising from this App, its installation and use, inability of use, failure of performance, error, omission, interruption, defect, malfunction, delay of operation, or loss of service on your device. This includes any damage to a mobile phone, its associated software, or any other application previously installed to the device.

Updates. The Ohio Lottery may offer automatic or manual updates to this App at any time and without notice to you. These updates are also subject to termination with or without notice to you.

Illegal Use. You may not use the App for any illegal purposes, expect where explicitly granted to you in this Agreement. The Ohio Lottery reserves all further rights. You do not acquire any intellection property rights, or other rights in the App, as a result of downloading the App.

Restrictions on Use. This App or its content may not be reproduced, duplicated, copied, sold, resold, reverse engineered, or otherwise exploited for any commercial purpose without the Ohio Lottery's express written consent. You may not frame, or utilize framing techniques, to capture or display any portion of this App or its content without the Ohio Lottery's express written permission. Any unauthorized use of this App may result in criminal prosecution, civil penalties, or both.

Privacy. The Ohio Lottery, its affiliates and designated agencies, may collect and use technical or other information relating to this App, and may share this information with others for product support, statistical reporting, or any other purposes consistent with applicable data protection laws.

The Ohio Lottery in no way guarantees that any information you submit though this App will remain private. In no event will the Ohio Lottery be responsible for any damages, including, without limitation, direct, indirect, incidental, special, consequential, or exemplary damages or expenses arising form the intentional or unintentional disclosure of such information to any third party.

Trademarks. Content included on this App, such as text, images, photos, logos, buttons, icons, screen savers, audio clips, digital downloads, data compilations, and software is the property of the Ohio Lottery or its content suppliers and is protected by United States and international trademark, copyright and intellectual property laws. You may not use any text, images, photos, logos, buttons, icons, screen savers, audio clips, digital downloads, data compilations, graphics, page headers, scripts, or software, without the express written permission of the Ohio Lottery and, where appropriate, the content provider. Any unauthorized use of such content may result in criminal prosecution, civil penalties or both.

Termination. The Ohio Lottery may, at any time and in its sole discretion, terminate, remove, disable access to, block, or modify this App for any reason and without notice. In no event will the Ohio Lottery be responsible for any damages including, without limitation, direct, indirect, incidental, special, consequential, or exemplary damages or expenses arising from the termination, removal, restriction of access, blocking, or modification of this App.

Content. The information available through this App is for entertainment purposes. While every attempt for accuracy is made, the information displayed on this App may not be accurate and is such cases will have no legal force or effect. A claim may not be premised on human, electronic, or other error in the communication, display or transmission of data, however recorded, displayed or transmitted, nor premised upon any intentional human, electronic or other form of communication or transmission of data that has not been authorized by the Ohio Lottery. You are solely responsible for verifying any winning number information related to a valid Ohio Lottery wager and hereby disclaim any reliance on the information displayed over this App.

MyLotto Rewards. In order to participate in the "MyLotto Rewards" Program functionality of this App, the Lottery may require that you provide specific "personal information" to the Lottery in the manner prescribed by the Lottery in order to establish or maintain an account. You may not maintain more than one account. The Lottery reserves the right to delete or close any account, or all accounts, at any time for any reason, including, but not limited to, the existence of multiple accounts for one individual. No one under eighteen (18) years of age may establish an account.

Mobile Cashing. All tickets have a limited validation period which is established by the Ohio Lottery Commission. Present rules call for tickets to be cashed within 180 days of the drawing date or 180 days from game closing for Scratch Offs. All EZPLAY Games tickets must be cashed within 180 days of purchase.

The scan of the original winning ticket initiates the payment of the prize. The ticket becomes void at completion of the mobile cashing process.

Prizes $50 to $25,000 can be claimed through the mobile cashing application.

Lottery prize amounts of $600 or greater are reported to the Internal Revenue Service. The Ohio Lottery will issue a W-2G form to the winner. Winners sharing a prize must contact the nearest Ohio Lottery Regional Office in order to cash the winning ticket.

Default Verification - Before the payment of any prize of $600 or more, Ohio Revised Code §3770.071, requires that The Ohio Lottery check for any default of a court or administrative order in Ohio, requiring the payment of child or spousal support. If any such debt exists, the Lottery is required to offset the prize by the amount of the debt. If you believe that prize money was withheld for a debt that has already been paid, it is your responsibility to contact the agency reporting the debt and seek reimbursement. We are not liable for any damages or losses resulting from any offset from a prize for payment of a debt.

Winners must certify that all information provided is true and accurate, to the best of their knowledge, and that the ticket has not been unlawfully obtained, made, altered, forged or counterfeited.

Please allow 1-3 business days for a bank account.  Please remember, the first transfer will take up to 7-10 days as the bank account information is verified. If you have not received your payment within these time frames, please contact The Ohio Lottery Claims Department at 1-800-686-4208.

Optical Recognition Use. This App may allow certain features of your device, such as the camera or a barcode reader, to quickly gather game information from an Ohio Lottery ticket, wager, promotion, advertisement piece, receipt or other form of media. In no event will the Ohio Lottery be responsible for any damages, including, without limitation direct, indirect, incidental, special, consequential, or exemplary damages or expenses arising from the erroneous entry of information, whether by a user, feature of your device, or by the App's optical character recognition program. It is your sole responsibility to ensure that any information entered into this App is accurate and disclaim any reliance on inaccurate or incomplete information, however entered.

Applicable Law. The use of this App, the Agreement, and any dispute regarding the Agreement, will be governed by and interpreted under the laws of the State of Ohio. Accordingly, any litigation regarding this App or the Agreement must be brought in the courts of the State of Ohio. Your acceptance of this Agreement will be considered as your giving irrevocable consent to jurisdiction in the State of Ohio.

If any provision of the Agreement is held unenforceable, the provision will be modified to reflect the intent of the Agreement where possible, or struck, if modification is not possible. All remaining provisions will remain in full force and effect.

Safety. Please do not endanger yourself and others by using the App while driving or engaged in any other activity that requires your attention.

Changes to Terms. The Ohio Lottery may, at any time and at its sole discretion, modify the Agreement for using this App. Any such modification will be effective upon posting in the terms and conditions section of this App, without any special notice of such changes. You are solely responsible for reviewing the Agreement before use, and any continued use of this App, as your acceptance of any modification to the Agreement.
